Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of thirty foot falls from the Portech Tower, metal platform, which was structurally weakened due to corrosive deterioration, on or about May 15, 1996. Among other methods, one feasible and acceptable method to correct this hazard is to implement a periodic, not to exceed yearly, facility/plant inspection and maintenance/repair program which is inclusive of metallic facility/equipment components, or appurtenances thereto, subject to structural deterioration. Reference is made to pages 64 and 68, Maintenance of Plant Facilities, Accident Prevention Manual for Business and Industry (Engineering and Technology); Pages 451, 453, 454 and 458, Building Construction and Maintenance Safety and Effective Plant Operations and Maintenance; Chapter 14 of Safety Consideration in Plant Operations, Standard Handbook of Plant Engineering and page 6-114, Corrosion, Marks Standard Handbook for Mechanical Engineers.
