Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were causing or
likely to cause death or serious physical harm to employees in that
employees were exposed to a fall
hazard from scaffold failure:
(a)Hege Silo Construction Site - Employees exposed to failure of the
wire-rope fastening
devices due to the use of non-approved u-bolt type clasps which were
improperly spaced.
These clasps were used on the silo building machine used to suspend
personnel when the
wire-rope suspension failed, as occured on June 1, 1994.
"AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO
CORRECT THIS HAZARD IS THE USE OF THE FIST GRIP TPYE FASTENING DEVICES."

employees were exposed to a fall
hazard from scaffold failure:
(a)Hege Silo Construction Site - Employees exposed to scaffold failure due
to all parts of
the equipment not being inspected and, where necessary, tested to
determine that they are
in safe operating condition.  Parts subject to wear such as, ropes,
bearing, gears, pins,
safety and governor parts shall be adjusted or replaced to prevent failure.
"AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO
CORRECT THIS HAZARD IS TO INSTITUTE A REGULAR SELF INSPECTION PROGRAM WITH
RECORDED RESULTS AS OUTLINED IN THE OPERATING MANUEL".
