Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from unintended actuation of a foot pedal/treadle, not protected by a guard: (a) Banding Area - Employees operate a Toy bander, broom banding machine, no serial number available, to assemble bristles to handles and no means was provided to protect the foot pedals from unintended activation by falling or moving objects or by someone accidently stepping on them, on or about November 22, 1993. (b) Shear Area - Employees operate a Peck-Stow & Wilcox shears, Number 1917, to shear metal strips and no means was provided to protect the foot treadle from unintended activation by falling or moving objects or by someone accidently stepping on it, on or about November 22, 1993. "AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THE HAZARD IS TO INSTALL A FOOT PEDAL/TREADLE GUARD." OR IN THE ALTERNATIVE 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by unintended activation oaf a foot pedal treadle. (a) Banding Area - Employees operate a Toy bander, broom banding machine, no serial number available, to assemble bristles to handles and no means was provided to protect the foot pedals from unintended activation by falling or moving objects or by someone accidently stepping on them, on or about November 22, 1993.
