Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from unintended actuation of a foot pedal/treadle, not provided with a guard. (a)Fabrication Shop - Employees operating a press brake number #30 and another press brake with no means provided to protect the foot pedals from unintended activation by falling or moving objects or by someone accidently stepping on it, on or about January 26,1994 "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO INSTALL A FOOT PEDAL/TREADLE GUARD. OR IN THE ALTERNATIVE 29 CFR 1910.212 (a)(l); Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by unintended activation of a foot pedal/treadle. (a)Fabrication Shop- Employees operate a press break, no serial number, and a press brake number 30 with no means provided to protect the foot pedal from unintended activation by falling or moving objects or by someone accidently stepping on it, on or about January 26,1994
