Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falling and crushing hazards.
a)Employees were exposed to falling from the bucket of a backhoe excavating
machine or being crushed between the bucket and the articulated boom.  An
employee was using the bucket of a backhoe as an aerial lift platform to
gain
access to an overhead television cable.  On or about 09/16/94.
Abatement:  Among others, a feasible method to eliminate or to materially
reduce this hazard
is to comply with Equipment Manufacturers Institute (formerly Farm and
Industrial Equipment
Institute) form #BL10-3 and not use a bucket for a work platform and to
provide and use an
aerial lift which is manufactured for the purpose, or use a ladder.,
