Section 5 (a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)3/8/94, at Port Henry Service Center, Port
Henry,NY,Employees were exposed to the hazard
of serious crushing injuries from the dropping of an
hydraulic automotive lift while employees were
working under vehicles on the lift. An automatic
safety locking device (Latch or Dog) was not
operational or provided on the lift in the service
area. Feasible and Acceptable methods among
others to correct hazard is to:
a)Install or repair automatic mechanical safety locking device on
lift.
b)Instruct and train employees in the proper use of mechanical
locking device for hydraulic lifts.
c)Conduct proper inspection of the lift as recommended by the lift
manufacturer, to insure that the safety locking device and all other
components are in safe operating condition.
d)Post manufacturers operating manual in the service area for
reference.
Generay Duty 5(a)(1) Requirements:
The employer had not rendered his workplace free from the hazard of
hydraulic lift not being
properly inspected and maintained.  Automatic safety device on lift was
nonexistant or not
maintained or operational.  This is necessary to hold the lift in the
event of hydraulic system
failure,this hazard is reasonably foreseeable. The owner of this service
center acknowledges that
a automatic safety device is lacking on this lift.  Lack of an automatic
safety device is a
recognized industry hazard evident by the fact that most lifts have
latches built into them.  ANSI
B153.11990 (Locking Devices Page 12) references safety requirements on
lifts.
A search of the OSHA Standards has been conducted and there are no
applicable
standards.
