Section (5)(a)(1) Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to falls: An employee, carpenter, standing on and capping a 4' wide arch on the roof of the building was exposed to a fall of 38'6" to the ground. The employee was not protected from the hazard of falls by wearing a safety belt and lanyard, or having some form of fall protection, such as a catch platform.
