Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falls: The spray down rack was not of sufficient height for employees to gain access to the bed of their truck's. Employees were climbing atop the side rails on the rack in order to spray their trucks. Among other methods, one feasible and acceptable abatement method to correct this hazard is to rebuild the rack high enough so that the walking platform would be approximately 42 inches below the top of the bed of the hauling trucks (allowing for standard railing on each open side of the platform).
