SECTION 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a.The hazard of being hit by falling trees.  The area around lodged trees
was not
kept clear of personnel until the tree was lowered to the ground, in the
logging operation in the
Weyerhaeuser timber cutting operation located two miles north of Hughes
Springs, Texas.
Among others, one feasible method of abatement, as specified in ANSI
03.1-1979 and published
in The American Pulpwood Logging Manual no. 92-A-6, and contained in the
Notice of
Proposed Rulemaking OSHA standard on Logging operations published in the
Federal Register
may 2, 1989, is the application of flags or other markers to lodged trees
to serve as a signal to
workers in the area of the presence of a lodged tree, and to lower the
tree
to the ground by a
safe method before any work is continued within two tree lengths of the
lodged tree.
