Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to: Dental staff employees were exposed to the hazard of being
infected by HBV and/or HIV through possible direct contact with blood
or other body fluids.
(a)  Members of the dental staff were not offered the opportunity
to receive the series of injections containing the hepatitis
B vaccine to prevent hepatitis B infection.
(b)  Members of the dental staff had received no training on
the proper methods to be used during needle re-capping.
Feasible methods of abatement as recommended by the CDC, include but
are not limited to:
(1)  The facilitys' infection control program shal identify employees
of substantial risk.  All such employees shall be offered the
Hepatitis B vaccination in amounts and at times prescribed by
standard medical practice.
(2)  Development and implementation of an (preferably written)
infection control program which include, but is not limited to,
mandatory training that explains that needles must never be
re-capped using two handed methods.
