Section 5(a)(1) of the Occupational Safety & Health Act of 1970:  The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees,
in that, employees were
exposed to:
CP102; North Loading Dock, North Main Pumping Station, Deer Island:
On October 12, 1993, the hazard of delayed rescue and possible injury
during entry into
and exit from the lube oil tank near the north loading dock of the north
main pumping
station.
Among other methods of abatement, included but not limited to institute a
confined space entry
program meeting the requirements of ANSI Z117.11989.  The program should
include:
1)Effective training of the authorized entrants, attendants and all
affected employees.
2)Completion of all portions of the permit to specify the nature of the
work to be
completed, and any necessary equipment, including rescue equipment.
3)Continuous air monitoring where there is a potential for entry of toxic
or hazardous air
contaminants.
4)Provision of effective means of communication by the attendant to
necessary rescue
services. AND
5)Use of fall arrest by entrant(s) where a winch and tripod is used for
entry or retrieval.
