Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to serious burns as a result of the following: 1) Flammable Storage Room: a)The sill for the flammable storage room was less than four inches. b)the room was not equipped with mechanical ventilation. c)The 55 gallon drum of Hexane was not grounded. 2) Downstairs, Shipping: a)The seven stored mixing tanks were not covered. 3) Paint Production Room: a)Open 37C, five gallon cans were used to transport flammable liquids from the 55 gallon drums to the mixing tanks. b)The employee failed to properly bond when he dispensed the contents of the open 37C, five gallon container into the mixing tank. c)The eight 55 gallon drums containing flammable liquids were not equipped with selfclosing valves. d)The drip cans used beneath the valves of the 55 gallon cans were not approved. e)Means for adequate bonding the open 37C, five gallon cans to the 55 gallon drums during dispensing operations were not provided. f)The three open five gallon cans were used to transport flammable liquids from the 55 gallon drums to the mixing tanks. 4) Lacquer Room: a)Utilize the appropriate safety can for transporting flammable liquids. Feasible and useful methods to correct the hazards among other methods are as follows: 1) Flammable Storage Room: a)Increase the height of the sill to four inches. b)Install mechanical ventilation. c)Ensure that all 55 gallon drums containing flammable liquids are grounded. 2) Downstairs, Shipping: a)Ensure that all mixing tanks are properly covered. 3) Paint Production Room: a)Utilize the appropriate safety cans for transporting flammable liquids. b)Ensure that all containers are properly bonded and grounded prior to dispensing flammable liquids. c)Install self-closing valves on all the 55 gallon drums. d)Place approved drip cans beneath the valves of the 55 gallon drums. e)Utilize bonding straps instead of relying on metal to metal contact during dispensingoperations. f)Ensure that all vessels containing flammable liquids are properly covered. 4) Lacquer Room: a)Utilize the appropriate safety can for transporting flammable liquids.
