P.L. 91-596 Section 5(a)(1) of the occupational Safety and health Act of
1970: The employer
did not furnish and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to the hazard(s) of falling off an elevated access platform:
a)  3430 Hwy 21 South - Employees were using an elevated working platform
for access to roof,
approximately 24 feet above ground, which was not secured to the lifting
carriage of the forklift,
on or about 11/18/97.
Among others, one acceptable and feasible abatement method to correct this
hazard would be
to ensure that elevated work platform be secured to the forks or the mast
of the forklift, as per
Part III, Section 7.35 of ASME B56.1-1993 outlines safe work practices for
Elevating Platforms.
