Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: At the job-site, located at 4309 Idalou Road, Idalou, TX: Employees operating an unguarded TENNSMITH Model 52A (air-actuated) metal shear were exposed to amputation hazards created by the lack of point of operation guarding and inadequate operator training, for the period of time up to and including 05/17/99. Feasible and acceptable abatement methods to correct these hazards would be to: 1) Install a holddown / with finger guard (modified for the specific corrugated metal pattern of the sheet metal being cut) similar to that provided by the manufacture as an original "Safety Device" and train operators in accordance with manufacturer's operators manual, train them how to recognize unsafe conditions and what actions they should take when these conditions are noted. 2) Position shear operators a sufficient distance away from the point of operation and use two- hand trips or a combination of a right foot operated treadle (secured to the floor) and a left hand trip (attached at operators immediate left side), and train operators in accordance with manufacturer's operators manual, train them how to recognize unsafe conditions and what actions they should take when these conditions are noted.ions
