P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard(s) of:
A- Establishment site - The "Morbark" tub grinder S/N 571-084, had the
clutch handle lock
bent, the clutch neutral safety switch hanging out of position by only one
mounting screw, the
warning horn not working, the tub rotation valve actuator unhooked from
the level, the stub
lever attached to the cross bar in the wrong position, and the safety
block for the tub
undeployed; therefore exposing the tub grinder operator and nearby
employees to the hazards
of being struck-by, pinned, and crushed by the tub grinder, conveyor, and
other moving and
rotating parts of the tub grinder. on or about 07/15/99.
Among other methods, one feasible and acceptable method to correct this
hazard is to develop
and implement an inspection schedule, and to adhere to the manufacturer's
"Safety Operator's
Manual", to ensure that this machine is always in good and safe working
conditions.r's
