Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to a crushing hazard from a shifting or falling load suspended by a crane in which the lifting points were attached to the ROPS of a shovel dozer.: Jobsite; Shaft Area: Employees were exposed to serious injury due to the lifting of a CAT 931B Shovel Dozer in which the lifting eyes were welded to the ROPS. Among other methods, one feasible and acceptable abatement method to correct this hazard is to attach the lifting eyes to the axles per the manufacturers specifications. X\ y y m "T
