Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of vessel rupture: Site: Top Side - Employees were exposed to the hazard of vessel rupture. The air receiver in use was damaged and not showing and ASME plate to indicate compliance with the ASME Boiler and Pressure vessel code. Per the visible pressure gauge, the compressed air system was running at 120psig. If the unit was originally in compliance with ASME and properly plated, the compliance with the code would end at the time it was damaged and should have been immediately taken out of service and the damage assessed by a competent, certified pressure vessel inspector. ABATEMENT NOTE: One feasible and acceptable method of abatement is to comply with the requirements of the American Society of Mechanical Engineers Section VIII.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to inadequate means of communication: At CP 282; Outfall Tunnel: In the following specific locations, employees could not reach the means of communication, ie mine phones, because the phones were overhead, out of reach and inaccessible from where they were standing, including in emergencies: 1)At marker 4313, mine phone was 9' from catwalk. 2)At marker 3415, mine phone was 10' from catwalk. 3)At marker 2820, mine phone was 10' from catwalk. 4)At marker 2620, mine phone was 7' from catwalk. 5)At marker 2515, mine phone was 7' from catwalk. 6)At marker 2430, mine phone was 8' from catwalk. 7)At marker 2430, mine phone was 8' from catwalk. ABATEMENT NOTE: One feasible and acceptable method of abatement is to lower the phones within arms reach and protect the phones by placing them within a plastic sleeve.
