Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to falls from an aerial lift that did not have its guardrails maintained in a safe manner: Jobsite; Paint Room, Column G-11: Employees were exposed to injury while working from a Wildcat scissor lift in which the guardrail locking-pins were replaced with aluminum wire to prevent displacement. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop a maintenance check list and to make repairs as the manufacturers recommends.
