Section 5(a)(1) of the Occupational Safety & Health Act of 1970:  The

employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees, in
that, employees were
exposed to the hazard of receiving serious injuries, from a possible
collapse of the platform, as
a result of walking and working on an Access Satellite Mast Climbing Work
Platform, where
modifications and alterations were made to an extension platform, which
was not in compliance
with American National Standards Institute, ANSI A92.9-1993, Section #
6.13. The standard
states that the owner shall not modify or concur in modification or
alteration to the Mast
Climbing Work Platform, without the modification being approved or
certified in writing by the
manufacturer or equivalent entity should the manufacturer be no longer in
business.
Jobsite; Building-C, Ground Level, North Exterior Side of the Building
Area:
On or about January 2, 1996, an employee of this company was exposed to
serious
injury while riding on/and or working on an Access Satellite Mast Climbing
Work
Platform, Serial # PM-249-A, where a modified extension platform was in
use without
being approved by the manufacturer, or a Professional Engineer, prior to
the beginning
of use.
