Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck by hazards.  The operator of the Self Contained
Post Driver (SCPD) was
propelling the truck mounted SCPD forward from the rear operator seat of
the SCPD machine.
The operator had obstructed view from SCPD operator seat, increasing the
risk of employees
being struck by the truck of the SCPD, or the operator being struck by the
on coming vehicles.
Jobsite- Highway Rt. 88 North, Westport, MA:
The operator of the SCPD machine, serial number 2280, was propelling the
truck mounted
SCPD along the breakdown lane of the highway, going from one guardrail
post to another.  The
operator was propelling the truck mounted SCPD by using an alternate
propel source that was
installed at the rear operator seat of the SCPD without the written
approval of the manufacturer.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to ensure that truck of the Self Contained Post Driver is moved from the
driver seat of the cab
of the truck as required by the manufacturer of the SCPD machine.
