Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to the hazard of being struck by crane parts:
WORKSITE: The employer did not ensure through appropriate training and
information, visual
observation and instruction that the employee/crane operator was competent
and had the skills
and knowledge/understanding in the process of setting up the two piece
bi-fold lattice fly
attachment on the Link Belt model HTC 8570 Hydraulic Truck crane:
On or about October 28, 2009, The upper half of the fly fell off from it's
stowed position and
the lower half of the fly attachment swung around, striking a vehicle
close by while the crane
operator was in the process of the above tasks.
Among other methods, one feasible and acceptable method would be to:
1. Follow the manufacturer's instructions for the proper Erection of the
Fly Base section from
the Stored Position.
2. Follow the requirements set forth in ANSI B30.15-1973 "Mobile Hydraulic
Cranes" which
states in 15-3.1.3(l): Booms which are being assembled or disassembled on
the ground with or
without support of the boom harness should be securely blocked to prevent
dropping of the boom
and boom sections.
3. Provide employees appropriate training and instruction on the
instructions.
4. Utilize other effective and safe procedures.
