Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by vehicular traffic: WORKSITE: On or about November 16, 2009: 1) The employees performing tree removal operations from the ground at the side of the road did not use warning signs and/or other traffic control devices to protect employees working along side and in the street from vehicular traffic. 2) The employees/flaggers directing traffic while standing in the middle of a two-lane road were not wearing high visibility clothing and/or hand signaling devices. Among others, one feasible and acceptable method to correct these hazards is to: 1. Follow the requirements set forth in Section 3.2 (Traffic Control) of ANSI Z133.1- 2006 Safety Requirements for Arboricultural Operations and Part 6, chapters 6E (Flagger Control) and 6F (Temporary Traffic Control Zone Devices) of the U.S. Department of Transportation (DOT) Manual on Uniform Traffic Control Devices (MUTCD). 2. Provide and enforce the use of high visibility clothing. 3. Provide and enforce the use of hand signaling devices such as flags or Stop/Slow paddles. 4. Provide and enforce the use of advanced warning signs to alert traffic. 5. Provide employees with appropriate training and information on company policies and the proper use of the equipment.
