Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by moving vehicles: HANDWASH TUNNEL: The employees, performing "handwashing" tasks of cars from both sides of the car carrying tracks/conveyor on the floor in the tunnel were exposed to the hazard of being struck by cars. On or about June 2, 2008, an employee was hit by a car that was being moved onto the conveyor/tracks and caught in between two (2) cars while crossing the conveyor/tracks and sustained serious multiple injuries from the incident. Among others methods, one feasible and acceptable means of abatement is to: 1. Establish and implement company rules, policies, and safe work practices pertaining to "handwashing" tasks in the tunnel. 2. Provide effective training and information in the established company rules, policies and safe work practices. 3. Enforce the established company rules, policies, and safe work practices. 4. Utilize other effective and useful methods and technologies available.es
