Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by the superstructure or death:
Jobsite:  The employer did not ensure through visual observation,
instruction, and training that
the operator of the Dresser 6200 Power Shovel (machine) turned the engine
off and followed
proper procedures at all times prior to exiting the cab of the machine.
On or about April 7, 2010, the operator of the machine was standing on the
crawler track of the
machine while the engine was still running in order to open the front
window of the cab. The
window, however, became dislodged and fell onto controllers, causing the
machine to move
forward and the superstructures to rotate. The employee fell off the track
onto the ground after
hit by the rotating superstructures and sustained serious injuries from
the incident. The machine
hit trees, brushes, a shed and a portion of a house.
Among others, one feasible and acceptable method of abating this hazard is
to:
1.Establish and implement procedures including (but not limited to)
engaging safety
devices, and shutting down the machine prior to exiting the cab.
2.Provide training to employees on these procedures.
3.Enforce the procedures through visual observations and instructions
prior to operating
the machinery.
