a) Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, on or about 02/27/98, employees working at the sulfur unloading terminal were exposed to the hazard of falling while working on top of 12-14 foot tank cars containing sulfur and not provided with a body harness and lanyard attached to substantial member of the tank car or other engineered means. ABATEMENT VERIFICATION REQUIRED.
