Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of being crushed by an overturned front end loader due to lack of approved Rollover Protective Structures (ROPS) on the equipment: (a) Two Caterpillar Model 910F front end loaders used for moving bulk fertilizer ingredients in the plant had the factory installed ROPS removed, on or about October 24, 1997. One feasible and acceptable abatement method to correct this hazardous condition would be to reinstall the factory ROPS on the equipment. "ABATEMENT VERIFICATION REQUIRED"ION
