Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the potential hazard of a toxic atmosphere: On or about October 22, 1997, employees were exposed to the potential of toxic atmosphere. In the Waste Water Treatment Building the company stores and uses incompatible chemicals such as 10.5sodium hypochlorite 165 gallons and acids such as 15-25hydrofluosilicic acid 220 gallons and sulfuric acid 55 gallons and ferric chloride 110 gallons approximately. These materials are not diked and may if spilt could mix on the floor or under the grate releasing chlorine gas. The hydrofluosilicic acid and sodium hypochlorite are dispensed in the same area and the hoses to the manifolds can be switched mixing incompatible materials. The employer failed to assure that these incompatible chemicals would not mix in event of spill or while dispensing. The distribution hoses were not labeled and the incompatible chemicals were not diked. This was observed on 10-22-97. a) A feasible and useful method of abating this hazard is the use of dikes or secondary containment to prevent mixing in event of spill and the labeling of the distribution hoses to reduce the chance of accidental switching.
