Section 5(a)(l) of the Occupational Safety and Health Act. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm in that employees were allowed to utilize a synthetic sling and chain attached to the Hitachi 300LC backhoe as a means of access to and from the lift station at the intersection of Landover Terrace and Biscayne Drive, on or about July 6, 1998. Among other methods, one feasible and acceptable method to correct this hazard is to prohibit the use of the backhoe bucket as a means of elevating personnel. For guidance, refer to the Safety Manual, For Users, Operators, And Maintenance Personnel, Hydraulic Excavator, published by the Construction Industry Manufacturers Association.
