Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees on December 9, 1994, were exposed to falling 18 ft to the ground from the roof edge of a Mark Trace Apartment building where they were installing aluminum siding on the fascia board without any means of fall protection. Among other methods, one feasible and acceptable abatement method is to provide safety belts and lanyards attached to a lifeline or provide a guarded mobile scaffold with platform of sufficient length, width, height and strength to protect employees installing siding.
