Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to the hazard of being infected by HIV/HBV:
Health care workers such as nurses and surgical assistants who
were exposed to the hazard of being infected by HIV/HBV through
possible contact with blood or other body fluids in that:
The employer's oral infection control (IC) policy did not
include mandatory training in the application of universal
precautions as evidenced by employees recapping needles using
the two hand method exposing the employees to bloodborne
pathogens.
Feasible and useful abatement methods for reducing the hazard,
among others are:
1) To insure that all employees with occupational exposure
participate in a training program.
2) Material appropriate in content and vocabulary to the
educational level present shall be used.
3) Training shall include:
a) Statement of epidemology symptoms of bloodborne
diseases.
b) An explanation of the employer's IC program.
c) An explanation of the appropriate methods for recog-
nizing tasks that may involve exposure to blood
or other infectious materials.
d) An explanation of procedures which will limit risk
of exposure to body fluid exposures.
e) An explanation of basis for selection of personal
protective equipment.
f) Consult 29 CFR 1910.1030 (Bloodborne Pathogens) which
went into effect 3/6/92, to ensure compliance.
