Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnished employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from employees not being restrained in forklift and heavy equipment in case of tipping and or rollover. (a)Pier 1 Terminal Area: Employees were not wearing seat belts when driving a Hyster forklift and Taylor forklift equipped with seat belts. AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO WEAR THE PROVIDED SEAT BELTS AS REFERENCED IN ASME B56.1 - 2000 "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS AND OSHA'S FORKLIFT TRAINING STANDARD".
