Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer
did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing hazards in the event the powered industrial truck
tipped over due to
its lack of an operator restraint system (seat belts):
a.Outside the shop at the north wall:  A Yale forklift, SN L403106, Model
No.
GLP05ORCJUAE08, was not equipped with operator restraints (seat belts) to
keep
operators restrained to the seat in the event that the machine tipped over.
Among other methods, one feasible method to reduce this hazard is to:
1.Install an operator restraint device, system or enclosure in accordance
with
American Society of Mechanical Engineers, ASME B56.1-2000, Safety Standard
for Low Lift and High Lift Trucks, Section 7.40
2.Train operators to wear restraint devices whenever they are operating
forklifts.
