Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Pier 53, Barge Maunaloa - The employer did not ensure that employees were trained in ladder safety, including safe means of ascent and descent. An employee fell 20 feet to his death while descending a straight ladder without the full use of both hands. The employee was carrying a paint can and paint brush when attempting his descent. One feasible and acceptable means of abatement is to ensure that employees are fully trained in all fall hazards associated with the work environment.
