Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falling from a traveling backhoe:
a.On 05/03/04 an employee, with the job title of oiler, was observed
riding on the back
of a Caterpillar backhoe while traveling the from Leone Airport worksite
to the
company's maintenance yard.  The employee was sitting on a ledge, behind
the operator,
without a seat or seatbelt.
ABATEMENT NOTE:
Among other methods, one feasible method to reduce this hazard is to
follow the manufacturer's
operator manual which prohibits riders on the machine without an
additional seat and seatbelt.
