Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees:
a)Faganeanea Road Project, section 2: On 3/13/2006, employee operated
Excavator IHI, No 15-112,
doing work, digging on the side of the road. Rebars were modified and used
as pins for the shovel,
instead of the pins originally provided by the manufacturer, to secure the
shovel or bucket. Slippage of
the coupling could result in unintended separation of the shovel during
operation or maintenance,
potentially striking an employee.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE
HAZARD IS:
1. To follow the Association of Equipment Manufacturers (AEM) "Safety
Manual for Operation and
Maintenance Personnel" which requires that damaged and missing parts are
repaired or replaced, and
2.To follow the Manufacturer's Operator Manual by using only service parts
meeting manufacturer
specifications, and
3.To train operators and maintenance personnel to inspect equipment for
defects and to complete service
and repairs before equipment is placed back in service.
