Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazard: a) Heavner Run, Leidy Township, PA, rightaway road, Side Boom Pipe Layer, Caterpillar No.572H, Co. No. 349, S40U804, Side Boom Pipe Layer was operated down a hill having a 42 per cent grade, transporting a 63 foot, 24 inch diameter steel pipe, exposing the operator to the hazard of equipment tipping over, November 2, 1991.
