Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that foot pedal mechanism(s) on machinery were not protected or were inadequately protected to prevent unintended operations from falling or moving objects or by accidendal stepping onto the pedals: (a) Allen Clark, Inc. - the foot lever/pedal of the Bostitch Model H Wire Stitcher, SN: HT 233, located in the Box Room of U.S.D.A. Establishment 8799A on the second floor was not guarded, April 26, 1991. (b) Allen Clark, Inc. - the foot lever/pedal of the Golden Belt 110V AC Stitcher/Stapler located in U.S.D.A. Establishment 8799 by the Sales Room door was not guarded, May 3, 1991. AMONG OTHER FEASIBLE AND ACCEPTABLE METHODS TO CORRECT THIS HAZARD WOULD BE ......... 1) install a rigid metal guard over and above lever/pedal.
