Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that foot pedal mechanism(s) on machinery were not protected or were inadequately protected to prevent unintended operations from falling or moving objects or by accidental stepping onto the pedals: (a) MW Press Brake (b) Chicago Press Brake (c) Peck, Stow & Wilcox (Pexto) Shear a) MIL/FAB Inc. - the foot pedal (attached to treadle bar) was not guarded on the MW Press Brake, Machine No. 1148, Model 2008, February 11, 1992. b) MIL/FAB Inc. - the foot pedal (attached to treadle bar) was not guarded on the Chicago Mechanical Press Brake (SDN P8167), February 11, 1992. c) MIL/FAB Inc. - the 2 inch diameter by 12 foot long tripping mechanism (round) for the Peck, Stow & Wilcox (Pexto) Shear, Model 10 U/O A, SN 661621, was not guarded, February 11, 1991. AMONG OTHER METHODS, SOME FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD ARE..... 1. Install a rigid guard over all points where tripping can accidentally occur; 2. Instruct and supervise employees the importance of tripping mechanisms being/staying guarded.
