Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: a) Kingston Metal Specialties Company, Plantwide - a shop built wood (skid type) platform was being used as a maintenance platform at heights of up to 16 feet, exposing employees to a fall from the inadequately constructed platform to the concrete floor belwo, December 30, 1991. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS ..... (1) a platform meeting the following requirements shall be secured to the lifting carriage and/or forks. a) the platform must have a slip resistant surface. b) the platform must be equipped with a guardrail system that complies with the following requirements: 1) the guardrail system must consist of a toprail, midrail and toeboard. 2) the toprail shall be positioned at a vertical height of not less than 39 inches nor more than 45 inches above the surface of the platform. 3) the toprail shall not deflect to a point lower than 39 inches above the surface of the platform when a 200 pound concentrated horizontal load is applied to it nor shall it permanently deform when such a load is applied to it. 4) the midrail shall be positioned approximately half way between the surface of the platform and the upper most surface of the top guardrail. 5) the access opening, through the guardrail system, must be protected by a device that provides protection equivalent to that provided by the guardrail system. (2) an operator shall be in the control position of the powered industrial truck. (3) overhead protection, if required by operating conditions, shall be provided. (4) means shall be provided to protect personnel, in the normal working position, from moving parts of the trucks that represent a hazard.
