General-duty citation text

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish his employees employment and a place of
employment which were free from recognized hazards that were causing or
likely to cause death or serious physical harm to employees in that
employees were exposed to:
a)   Employees were exposed to suffocation, death, or
entrapment in confined spaces under and around the kilns
where they were required to clean the dust out of the
tunnels:
1)   A confined space permit system was not in place.
2)   Atmospheric testing was not done prior to confined
space entry.
3)   An emergency response rescue program was not in
place.  Among other methods, one feasible and acceptable
abatement method to correct this hazard is the
implementation of a confined space program in accordance
with ANSI Z117.1-1989.
