Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The controlling contractor Village Homes did not ensure that all subcontractors provided proper fall protection. The employer did not furnish his employees employment and a place of employment which were free from recognized hazards which were likely to cause death or serious physical harm to employees in that when employees were exposed to fall hazards exceeding 10' to concrete floors below while framing residential homes. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to work off scaffolds or properly placed ladders or provide other adequate fall protection.
