Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, the employer did not follow the Standard Operating Procedures of the company's emergency action plan. Employees were exposed to fires, explosions and other emergencies without a training program for employees to assist in emergency evacuation, employees are not given a review of the emergency plan to ensure knowledge of their responsibilities, a review of the fire prevention plan and training on responses to distinctive emergency signals. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to develop, implement and enforce a comprehensive fire prevention plan for the Comanche Plant. Train and designate employees to assist in emergency evacuation, allow employees to review the emergency action plan, make that plan available for employee review and train employees on actions taken for different emergency signals. The fire prevention plan needs to address the following: 1)List all major workplace fire hazards and their proper handling procedures. 2)all types of fire protection equipment and systems to control fires. 3)all names or job titles responsible for maintenance of equipment and systems. 4)and names and job titles responsible for control of fuel source hazards.

Section 5(a)(1) of the Occupational Safety and Health Act of 1910; The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees, in that employees were exposed to a number of fires and one explosions due to the lack of a dust suppression system. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to equip, replace or refit the entire coal handling system with a dust suppression system.
