Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard when being raised on a wooden pallet by a
material lift to access
the openings of a grain bin.
a) At the time of the inspection, two laborers were being raised on a
pallet to inspect Tank #34.
The following problems were found;
1. No fall protection used when lifted to a height of 15 feet.
2. Pallet was not secured to the forks of the material lift.
3. The pallet did not have a slip resistant surface.
Abatement method would include complying with ANSI B56.1-2000 Section 4.17
and Section
7.36.
Abatement certification and abatement documentation is required for this
violation.  The
documentation should include written verification of abatement, applicable
measurements or
monitoring results, and photographs or videos which you believe will be
helpful.  The abatement
certification sheet is enclosed with the citation.
