Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by vehicles hoisted on the two hydraulic automotive lifts in the inside service bays due to missing safety bars, with positive locking devices, that would support the vehicles in the event of hydraulic failure. (a) Among other methods, one feasible and acceptable method to correct this hazard is to remove the hoists from service until the safety bars and locks are repaired to the hoist manufacturer's specifications or, in the alternative, provide and strictly enforce the use of positive locking jack stands to be used whenever a vehicle is raised on the hoists.
