Section 5(a)(1) of the Occupational Sagfety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck: (a) Yard Area: During the months of November and December of 1993, employees were exposed to the hazard of being struck by a steel rack which could have been knocked or blown over by the wind. One feasible and acceptable method would be to secured these racks against movement by lag-bolting them down to the concrete supporting pad.
