Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Jobsite: An employee was exposed to a serious fall hazard while standing on the top rail of a guardrail system of a two-point suspended scaffolding, installing copper flashing at the base of the steeple. Among other methods of abating this condition would be to utilize tubular welded scaffolding to provide a substantial work platform with standard guardrails.
