Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential for serious injury caused by the possible overloading of a lifting beam (yoke): a) Locomotive Shop, Track 5, employees were permitted to use a lifting device (yoke) which had not been proof tested with certification and did not have the load capacity marked on the device. The lifting beam is used to lift the under carriage trucks of locomotives; 2/26/93 Among other methods, one feasible and acceptable method to correct this hazard is to proof test the lifting beam (yoke), certify the test and mark the capacity on the device.
