Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that are causing or likely to cause death or serious physical harm to his employees in that employees were permitted to climb over or through guardrails to access a portable extension ladder and or the scaffolds. Scaffolds were at a height of approximately 20 feet, creating a falling hazard.. a) Waste Water Treatment Plant, Seaford, De.- Oxie Wall #1 b) Waste Water Treatment Plant, Seaford, De.- Oxie Wall #2 c) Waste Water Treatment Plant, Seaford, De.- Oxie Wall #3 A feasible method of abatement to correct this hazard would be to alter the guardrail system to allow unobstructed access on/off the form scaffolding.
