Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to tipping of machinery due to unauthorized modification:
(a)  On or about February 23, 1996, modifications had been made to the
Series B, Case
MaxiSneakers,
Hydra Borers, in that a reel carrier had been welded on the
frame of the machine, in
back of the operators seat, to house two eighty pound cable reels.  This
modification had not
been approved by Case, the manufacturer, and it exposed operators to
crushing and other bodily
harm due to machine tipping over .
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to have approval of proposed modification(s) from the manufacturer prior
to installing such
modification(s).
