Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by concrete blocks falling from a Bessematic Concrete Block Unloader which was being operated without a safety limit switch, on or about January 31, 1995. This switch would disable the equipment in case of a pallet jam, and would prevent the rack from being pushed off the back side of the rack conveyor. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a replacement safety limit switch.
